Domain Name Registration & Management by GippsHost

These Terms and Conditions apply to all domain name registration and management services provided by GippsHost, operated by Aaron Patton (ABN 51 049 938 660). By ordering or using a domain name service from GippsHost, you agree to be bound by these Terms.
1. About These Terms
1.1 These Terms and Conditions govern the supply of domain name registration, renewal, transfer and management services by GippsHost to you.
1.2 By ordering or using the service you confirm that you:
- Are authorised to enter into this agreement
- Will comply with these Terms
- Will ensure anyone managing the domain through your account also complies
1.3 These Terms operate alongside:
- Your order confirmation
- The policies of the relevant domain registry (e.g. auDA for .au domains)
- GippsHost Privacy Policy
- Any applicable laws and regulations
2. Description of Service
2.1 GippsHost provides domain name registration, renewal, transfer and DNS management services.
2.2 GippsHost acts as a reseller through an accredited wholesale registrar. As such:
- Domain registrations are processed through an ICANN-accredited and auDA-accredited registrar
- GippsHost does not directly operate the domain registry infrastructure
2.3 The service includes:
- Domain name registration with the relevant registry
- DNS hosting and management (where selected)
- Domain renewal processing
- Domain transfer assistance
- Customer support provided by GippsHost
2.4 The service does not include:
- Web hosting (available separately)
- Email hosting (available separately)
- Website design or development
- Legal advice regarding domain name disputes
3. Eligibility
3.1 To register a domain name you must:
- Be at least 18 years old
- Provide accurate registrant contact information
- Meet any eligibility requirements for the chosen domain extension
3.2 Australian domain names (.au) have specific eligibility requirements set by auDA, including:
- .com.au / .net.au — Requires an active ABN, ACN, or Australian trademark
- .org.au — Requires registration as a not-for-profit entity
- .id.au — Available to Australian citizens and permanent residents
- .au — Requires Australian presence (citizen, resident, or registered entity)
3.3 You are responsible for maintaining your eligibility for the duration of the registration. Domains may be suspended or cancelled if eligibility lapses.
3.4 GippsHost may refuse to register a domain where eligibility cannot be verified or fraud is suspected.
4. Domain Registration
4.1 Domain name registration is subject to availability at the time of processing.
4.2 GippsHost does not guarantee that a domain name will be successfully registered, even after payment is received.
4.3 If a registration fails, GippsHost will refund the registration fee in full.
4.4 Domain names are registered for the period selected at the time of purchase (typically 1-5 years for .au domains, 1-10 years for other extensions).
5. Domain Renewals
5.1 Domain names must be renewed before their expiry date to remain active.
5.2 GippsHost will send renewal reminders prior to expiry.
5.3 GippsHost is not liable for domains that expire due to non-renewal, regardless of whether a reminder was received.
5.4 Expired domains may enter a redemption period during which they can be recovered at an additional cost. After the redemption period, the domain may be released for public registration.
6. Domain Transfers
6.1 Domains may be transferred to GippsHost from another registrar, subject to registry transfer policies.
6.2 Transfer requirements may include:
- A valid EPP/authorisation code from the current registrar
- The domain must be unlocked at the current registrar
- The domain must not be within 60 days of initial registration (for some extensions)
6.3 Transfer timeframes vary by extension (typically 5-7 days for gTLDs, near-instant for .au domains).
7. DNS Management
7.1 Where DNS hosting is selected, GippsHost provides DNS record management for the domain.
7.2 Changes to DNS records may take up to 48 hours to propagate globally.
7.3 GippsHost is not responsible for service interruptions caused by incorrect DNS configuration made by the customer.
8. Registrant Information (WHOIS)
8.1 Accurate registrant contact information must be provided and kept up to date.
8.2 Providing false or inaccurate WHOIS information may result in domain suspension or cancellation.
8.3 ID Protection (WHOIS privacy) is available for supported domain extensions. When enabled, the registrant personal details are replaced with privacy service details in public WHOIS lookups.
9. Billing and Payments
9.1 Domain registration and renewal fees are payable in advance.
9.2 Prices are listed in Australian Dollars (AUD) and include GST.
9.3 GippsHost may change domain pricing. Price changes apply to new registrations and renewals from the date of change.
9.4 Refunds are not available for completed domain registrations, as registration fees are non-recoverable once processed by the registry.
10. Acceptable Use
You must not use domain names registered through GippsHost to:
- Engage in illegal activities
- Conduct phishing, fraud, or impersonation
- Distribute malware
- Infringe trademarks or intellectual property
- Send spam or bulk unsolicited communications
GippsHost may suspend or cancel domains used in violation of these terms.
11. Suspension and Cancellation
GippsHost or the registry may suspend or cancel a domain if:
- Eligibility requirements are no longer met
- WHOIS information is inaccurate
- The domain is used in violation of acceptable use policies
- Payment is overdue
- Required by law, court order, or registry policy
12. Liability
12.1 GippsHost will take reasonable care in managing domain services.
12.2 However, GippsHost is not liable for:
- Loss of a domain name due to non-renewal
- Failed registrations due to registry issues
- Domain disputes between parties
- Loss of business, revenue, or data
- Indirect or consequential losses
12.3 To the extent permitted by law, GippsHost liability is limited to the fees paid for the affected domain service.
13. Privacy
GippsHost collects and stores personal information required to register and manage domains.
Information may be shared with:
- The wholesale registrar
- Domain registries (e.g. auDA, ICANN)
- Payment processors
- Regulatory authorities where required

14. Domain Disputes
14.1 Domain name disputes (e.g. trademark claims) are handled through the relevant dispute resolution process:
- .au domains — auDA Domain Name Dispute Resolution Policy
- gTLDs (.com, .net, etc.) — ICANN Uniform Domain-Name Dispute Resolution Policy (UDRP)
14.2 GippsHost is not a party to domain name disputes and will comply with any binding decisions made through these processes.
15. Changes to These Terms
GippsHost may update these Terms from time to time. Updated versions will be published on the GippsHost website and take effect upon publication unless otherwise stated.
16. Governing Law
These Terms are governed by the laws of Victoria, Australia.
