nbn® Internet by GippsHost

These Terms and Conditions apply to all nbn® Internet services provided by GippsHost, operated by Aaron Patton (ABN 51 049 938 660). By ordering or using an nbn® service from GippsHost, you agree to be bound by these Terms.

1. About These Terms

1.1 These Terms and Conditions govern the supply of nbn® Internet services by GippsHost to you.

1.2 By ordering or using the service you confirm that you:

  • Are authorised to enter into this agreement

  • Will comply with these Terms

  • Will ensure anyone using the service through your account also complies

1.3 These Terms operate alongside:

  • Your order confirmation

  • Your plan information or Critical Information Summary (CIS)

  • GippsHost’s Acceptable Use Policy

  • Any applicable laws and regulations

If there is any inconsistency, the order confirmation and CIS take precedence over these Terms.

2. Description of Service

2.1 GippsHost provides broadband internet services delivered via the nbn® network.

2.2 GippsHost uses wholesale carrier infrastructure to deliver services. As such:

  • The physical network is operated by nbn® and upstream providers.

  • GippsHost does not control the underlying infrastructure.

2.3 The service includes:

  • Internet connectivity to your premises

  • Access to the GippsHost network and upstream internet providers

  • Customer support provided by GippsHost

2.4 The service does not include:

  • Customer equipment unless specifically purchased

  • Wi-Fi performance guarantees

  • Internal network support unless agreed separately

3. Eligibility

To sign up for this service you must:

  • Be at least 18 years old

  • Provide accurate account and contact information

  • Have an eligible address connected or ready to connect to the nbn® network

GippsHost may refuse service where:

  • The address cannot be serviced

  • Credit or fraud risk is identified

  • Installation requirements cannot be met

4. Equipment

4.1 Some technologies require an nbn® Network Termination Device (NTD) installed at the premises.

4.2 You are responsible for:

  • Your router or modem

  • Internal wiring

  • Power supply to equipment

4.3 GippsHost is not responsible for issues caused by:

  • Faulty routers

  • Poor Wi-Fi coverage

  • Internal wiring faults

  • Customer network configuration

5. Speeds and Performance

5.1 Internet speeds depend on several factors including:

  • nbn® technology type

  • Network congestion

  • Your equipment

  • Wi-Fi conditions

  • Server performance

5.2 Advertised speeds represent the maximum possible speed for the plan, not guaranteed speeds.

5.3 Typical evening speeds are outlined in the Critical Information Summary (CIS) for your plan.

5.4 GippsHost does not guarantee that services will operate without interruption.

Network outages, maintenance, and upstream carrier issues may occur.

6. Service Availability

6.1 Service availability is dependent on the nbn® network and upstream carriers.

6.2 Planned maintenance may occur periodically and may temporarily affect service.

6.3 GippsHost will make reasonable efforts to notify customers of planned outages where possible.

6.4 Emergency maintenance may occur without notice.

7. Acceptable Use

You must not use the service to:

  • Engage in illegal activities

  • Distribute malware or malicious traffic

  • Launch denial-of-service attacks

  • Send spam or bulk unsolicited communications

  • Access systems without authorisation

GippsHost may suspend or terminate services if misuse is detected.

8. Fair Use

Unlimited plans are intended for normal residential or business usage.

Activities that may be considered excessive or abusive include:

  • Running large-scale public servers

  • Automated traffic generation

  • Bandwidth reselling without approval

  • Network abuse impacting other users

Where usage significantly impacts the network, GippsHost may:

  • Request usage changes

  • Apply traffic management

  • Suspend the service

9. Billing and Payments

9.1 Services are billed in advance on a monthly basis.

9.2 Payment methods may include:

  • Credit card

  • Other methods approved by GippsHost

9.3 Failure to pay invoices may result in:

  • Service suspension

  • Late fees

  • Service termination

9.4 Customers remain responsible for all charges incurred on their account.

10. Changes to Plans or Pricing

10.1 GippsHost may change pricing or plan features.

10.2 Customers will be provided at least 30 days notice of price increases.

10.3 If you do not accept the change you may cancel the service prior to the change taking effect.

11. Suspension or Termination

GippsHost may suspend or terminate services if:

  • Payments remain overdue

  • Acceptable use violations occur

  • Fraud or security risks are identified

  • Network abuse is detected

Customers may cancel services at any time by providing notice through their client portal or contacting support.

12. Relocation

If you move premises:

  • The service may be transferred where available

  • New installation charges may apply

  • Some technologies cannot be transferred

Service availability depends on the new address.

13. Liability

13.1 GippsHost will take reasonable care in delivering the service.

13.2 However, GippsHost is not liable for:

  • Loss of business or revenue

  • Loss of data

  • Indirect or consequential losses

  • Interruptions caused by upstream providers

13.3 To the extent permitted by law, GippsHost’s liability is limited to the value of the affected service period.

14. Privacy

GippsHost collects and stores personal information required to deliver services.

Information may be shared with:

  • nbn®

  • Wholesale network providers

  • Payment processors

  • Regulatory authorities where required

All data is handled in accordance with Australian privacy laws.

15. Emergency Services

Voice services provided over internet connections may not function during:

  • Power outages

  • Internet outages

  • Network faults

Customers should ensure alternative access to emergency services where necessary.

16. Changes to These Terms

GippsHost may update these Terms from time to time.

Updated versions will be published on the GippsHost website and take effect upon publication unless otherwise stated.

17. Governing Law

These Terms are governed by the laws of Victoria, Australia.
